Planning Application approved
Frankham Projects Ltd were approached by the client after having a planning application refused for the construction of a residential dwelling on a protected employment site.
Frankham reviewed the decision, planning policy for the area and formulated an appeal against the decision.
We are delighted the Inspector agreed with the points raised on behalf of the client, that only one of the tests of the policy were required to be met and that the Council had erred when applying their policy in that, they only assessed whether the site was capable of being used for employment purposes rather than whether it was suitable.
Comments from Frankham, in relation to the Council’s suggested conditions, were also taken on board by the inspectorate with the pre-commencement conditions reduced from 4 to 1.
Conditions restricting the dwellings permitted development rights were removed all together.
